The second indictment states “on or about the 18th day of April, 2020, … intentionally or knowingly cause bodily injury to [2nd child] by striking [2nd child] on the head with the hand of the defendant.”

According to Texas Penal Code §12.34, a Third Degree Felony carries a mandatory imprisonment in the institutional division for not more than 10 years or less than two years; and in addition to imprisonment, may receive a fine not to exceed $10,000, if convicted.

Godfrey was released Wednesday morning on $30,000 bond.
